This guide is for the professionals behind San Francisco estate sales. That means probate and trust attorneys, licensed professional fiduciaries, conservators, successor trustees and bank trust officers.
It covers which steps the law assigns to counsel and the personal representative, and what Allison's process covers. At confirmation, the court examines the efforts made "to obtain the highest and best price for the property reasonably attainable."1
Allison Chapleau's San Francisco probate, trust and partition sales page lists what attorneys and executors receive from her process:2
- Defensible documentation suitable for filing
- Predictable timelines with contingency planning
- Active management of confirmation requirements
- Direct, structured communication
The rest of this guide covers where each of those fits into San Francisco's rules. If you're an executor rather than counsel, our guide to choosing a probate Realtor in San Francisco is written for you. Nothing here is legal advice.
Who This Guide Serves in San Francisco: Attorneys, Professional Fiduciaries, Conservators and Trustees
The people who refer estate property in San Francisco don't all work under the same rules.3,4,5
Probate attorneys represent the personal representative in a court-supervised estate.3 In San Francisco, counsel must appear at hearings to confirm sales of real property.6
Licensed professional fiduciaries have a defined role under California law.7 The term covers a person who acts as conservator, guardian or personal representative for two or more unrelated people at once.7 It also covers someone acting as trustee or agent under a durable power of attorney for four or more people at once.7 Trust companies and FDIC-insured institutions are excluded, and so are their employees acting within the scope of that job, such as a bank trust officer.7
A license is required to act as a professional fiduciary in California.8 That requirement doesn't apply to licensed attorneys.8 Narrower exceptions cover CPAs and IRS enrolled agents working within their scope of practice.8 You can check a fiduciary's status through the Professional Fiduciaries Bureau license lookup.9
The Bureau's code of ethics tells fiduciaries to "avoid actual conflicts of interest or the appearance of a conflict of interest." It also tells them to manage the estate with prudence and "maintain detailed records."10
Clear Lanes: What Counsel Does and What the Listing Agent Does on a San Francisco Court-Supervised Sale
The Probate Code and San Francisco's local rules assign some steps to the personal representative and counsel.6,11,12 Allison's service page lists what her probate process handles.2
Counsel and the personal representative
- Getting court permission for an exclusive listing11
- Giving notice of proposed action under full IAEA authority13
- Filing the Report of Sale12
- Appearing at the sale confirmation hearing6
- Completing the clerk's overbid form6
Allison's listed probate services
- Court-ready, market-supported valuation2
- Pricing structured for confirmation scrutiny2
- Full listing, marketing, and access coordination2
- Buyer qualification and overbid preparation2
- Escrow oversight aligned with court timelines2
San Francisco's probate court sits in Department 204 at the Civic Center Courthouse, 400 McAllister Street.14 Its local rules require counsel to appear at confirmations of sales of real property, even if a continuance is needed.6 Confirmation hearings run at 9:00 a.m. Monday through Wednesday, and they're the first matters called.6
What the Agent Supplies at Each San Francisco Probate Filing Step
The sections below follow the main filings and notices in a San Francisco probate sale, and where the agent's work fits.
The Exclusive Listing Petition in San Francisco
Authority comes first. A personal representative with only limited authority under the Independent Administration of Estates Act (IAEA) still needs court supervision to sell real property.3 One with full authority has the power to sell, and that kind of sale skips the court-confirmation steps, including publication, the 90 percent rule and court approval of the commission.15,16
In a court-supervised estate, an exclusive listing has limits.11 Under Probate Code section 10150, it can run no more than 90 days.11 The personal representative needs the court's permission first, showing necessity and advantage to the estate.11 Each extension also needs permission and can't exceed 90 days.11
California's Rules of Court list what the petition must state: a description of the property, the broker's name, a summary or copy of the listing terms, and the facts showing necessity and advantage.17
San Francisco asks for more. Its local rule lets non-IAEA personal representatives, conservators and trustees of conservatorship-related trusts apply ex parte, with the agreement attached.6 The petition must give the broker's name and office, "his or her experience with sales of real property in the area of the subject property," and the properties to be sold.6 The court's own checklist of common delays includes failing to attach the agreement and failing to give reasons why the exclusive listing is advantageous.18
That means the broker's local record goes into the filing itself.6 Here's Allison's. She's a Senior Vice President at Compass Commercial Brokerage19 with more than 24 years of San Francisco multi-unit experience, 300+ multi-unit and mixed-use buildings sold, and 30+ court-supervised sales.20 Between 2021 and 2025, she was the #1 listing agent in the city by number of 2-4 unit listings and by number of 5+ unit listings, per Broker Metrics.19
Valuation, the Probate Referee and the 90 Percent Rule in San Francisco
The personal representative files an inventory and appraisal within four months after letters are first issued.21 The probate referee appraises the property the representative doesn't appraise.22 The representative delivers the inventory to the referee "together with necessary supporting data."22
For a private sale to be confirmed, the property must have been appraised within one year of the confirmation hearing.23 The offer must be at least 90 percent of that appraised value.23 San Francisco requires the appraisal, and any reappraisal for sale, to be on file before the hearing.6 Its local rules also say waivers of referee appraisal "are not favored."6
That supporting data comes from the representative.22 Allison's team describes its first step as "Value & position," working from the rent roll, tenancy, expenses and comparable sales.24
Notice of Proposed Action Under Full IAEA Authority in San Francisco
With full authority, the representative can sell without court confirmation by giving a notice of proposed action.13,16 For a real property sale, the notice must state the material terms, including the sale price and the commission or how it's calculated.25 It goes out at least 15 days before the date the action will be taken.26 If someone delivers a written objection and the representative still wants to sell, the sale has to go through court supervision instead.27
The agent can help by getting the final price, commission and key terms to counsel in writing, since the notice has to state them.25
One example from Allison's sales: 1128 60th Avenue in Oakland was a "Probate Sale Not Subject to Overbid," with Allison representing the seller.28 It sold in July 2025 for $307,000, which was $32,000 over list.28

Publication, Offers and the Report of Sale in San Francisco
In a court-supervised sale, notice of the sale is usually published in a newspaper in the county where the property sits.29 There are exceptions, such as when the will directs or authorizes the sale.29,30
San Francisco's local rule treats the published notice as a solicitation for offers.6 No offer can be accepted, and no Report of Sale can be filed, until the bidding period in the notice expires.6 The returned offer can't vary from the terms in the notice.6 If an exclusive listing was given, the notice has to say so.6
That shapes the marketing calendar. An offer that arrives early can't be accepted until the bidding period runs.6
The court examines the representative's efforts "to obtain the highest and best price for the property reasonably attainable." Interested people can object in writing and testify at the hearing.1
The sale is reported on Judicial Council form DE-260, the Report of Sale and Petition for Order Confirming Sale of Real Property.31 The order is form DE-265.32 If the representative doesn't file within 30 days after the sale, the buyer may file.12
The San Francisco Confirmation Hearing and the Overbid
At the hearing, the court must accept a higher written offer if it satisfies three conditions.33 It must be at least 10 percent more on the first $10,000 of the original bid and 5 percent more on the rest.33 It must come from a responsible person.33 And it must comply with the law.33
On a $1,600,000 accepted offer, that's $1,000 plus $79,500.33 The first overbid must be at least $1,680,500.33
San Francisco adds local steps:6
- An overbidder whose bid is confirmed must bring a certified or cashier's check for 10 percent of the initial overbid amount.6
- The courtroom clerk gives counsel an overbid form, due back before the end of that morning's probate hearings.6
- Continuances are granted only in exceptional circumstances.6
- When the estate holds a partial interest, the petition must show the overbid calculated on 100 percent of the property value.6
Allison's probate process lists "Buyer qualification and overbid preparation." Her partition process lists "Two-phase marketing built for overbid performance."2
Commissions on San Francisco Probate Sales
On a court-confirmed sale, the court fixes the broker's compensation.34 It can't exceed the listing contract.35 The estate owes no commission unless a sale is made, confirmed by the court and closed.36 It owes none if the broker buys the property, or if the buyer's broker has an interest in the buyer.37
When an overbidder represented by a different broker wins in court, the Probate Code sets out who is paid what.38,39,40,41 Section 10165 covers one common case. The original bid came from one broker's buyer, and a different broker's buyer wins with an overbid.41 The winning broker then gets half the commission on the original bid and all of it on the increase.41 The other half goes to the broker who produced the original bid, the broker holding an exclusive listing, or both, depending on the facts.41 Other scenarios fall under different sections, so counsel should confirm the split for the specific case.38,39,40
San Francisco ordinarily allows total broker commissions of no more than 5 percent of the sale price, or 10 percent for unimproved property.6 The rule notes that commissions are negotiable.6 The order confirming sale must show the total commission and any agreed split between brokers.6
Conservatorship Sales in San Francisco: Rules Fiduciaries Should Know Before Listing
Conservatorship sales follow their own rules, and some of them affect what an agent should do early on.4,42
Under Probate Code section 2540, sales of conservatorship property are subject to court authorization, confirmation or direction, with listed exceptions.4 The procedures for notice, reappraisal, minimum price, Report of Sale and commissions follow the estate-sale rules "as nearly as may be." The IAEA provisions don't apply.42
The conservatee's home gets extra protection:
- Notice before spending. The conservator must notify the court of a proposed sale of the conservatee's present or former home before committing any significant resources to it, with limited exceptions.4 For the agent, that's a reason to check with counsel before any staging, repairs or marketing spend.4
- A high bar. The court may authorize the sale only on clear and convincing evidence of a compelling need to sell for the conservatee's benefit.43
- Fresh value. If the last appraisal of the home is more than six months old at the confirmation hearing, a new one is generally required.42
- Best-interest showing. Under independent powers, the conservator must show that the price, commissions, tax consequences and effect on government benefits are in the conservatee's best interests.44
- Closing paperwork. After a sale under independent powers, the conservator must serve and file the final escrow settlement statement within 15 days of the close of escrow.44 The agent can line up escrow so that statement is ready.44
One more rule shapes vendor choice. A conservator who isn't a trust company may not hire or refer business to an entity in which the conservator, or an employee, has a financial interest.45
Trust Sales for San Francisco Successor Trustees and Trust Officers
A trustee has the powers in the trust document, and those given by statute unless the trust limits them, without needing court authorization.5 That includes the power to sell trust property at public or private sale.46 A trustee may also hire agents to help.47
The duties don't go away, though. A trustee must deal impartially with multiple beneficiaries.48 They must act with the care a prudent person would use.49 They must keep beneficiaries reasonably informed and report on reasonable request.50,51
Allison's trust sales approach, from her service page:2
- Market-grounded valuation supported by comparable sales
- Strategy aligned with distribution timelines and trustee obligations
- Evaluation of private vs. open-market sale options
- Structured communication to manage beneficiary expectations
The outcome her page describes includes "clear documentation from valuation through closing." Her trust sales list includes these San Francisco properties:2
- 1577 Shrader Street in Cole Valley, a single-family home with development opportunity.2,52 Sold April 2026 for $3,500,000, $1,205,000 over list, delivered vacant with multiple offers.52
- 688-98 Corbett Avenue in Twin Peaks, six units.53 A trust sale with Allison representing the seller.53 Sold May 2019 for $1,830,000, with one unit delivered vacant.53
- 746-748 7th Avenue in the Inner Richmond, two units sold by Allison's team.54 Sold September 2024 for $1,600,000, with the lower unit delivered vacant and the upper unit tenant-occupied under a lease that started April 1, 2006.54

When the San Francisco Estate Owns a Building: Tenants, Rent Rolls and Estoppels
Some San Francisco estates and trusts hold more than a house. Allison's trust sales list includes a two-unit building in the Mission, six units in Twin Peaks and a two-unit mixed-use property in the Inner Mission.2 That changes the work.
Tenant disclosures. Under the San Francisco Rent Ordinance, before rental property covered by its eviction rules is sold, the owner or seller must disclose tenants' rights during and after the sale.55 The disclosure must say tenants can't be evicted or asked to move solely because the property is being sold.55 It must explain that showings are governed by California Civil Code section 1954 notice rules.55 It must also say tenants aren't required to sign estoppel certificates, except as required by law or their rental agreement.55 Counsel should decide how this applies to a particular estate or trust seller. The city's page on tenant rights during a sale summarizes the rule.55
Rent rolls and showings. Allison's marketing package includes the current rent roll and proposed financing scenarios.56 Her showing practice notes that tenant-occupied units require 24-hour notice.56
Defensible price. A court confirms a sale only if the price isn't disproportionate to the property's value.34 Allison's About page says her pricing is built on "careful study of recent sales, cap rate movement, rent multiples, and active buyer demand."19 Our guide to valuing an apartment building in San Francisco covers the methods.
Co-op apartments. San Francisco's local rule says a co-op sale won't be confirmed subject to the buyer later getting board approval.6
Two trust sales from Allison's list were tenant-occupied buildings:2
- 1616 Golden Gate Avenue, 12 units in the Western Addition, all tenant-occupied.57 Sold September 2025 for $4,250,000.57
- 813-817 Kansas Street, five units on Potrero Hill, all tenant-occupied, with Allison representing the seller.58 Sold March 2025 for $1,769,000 with multiple offers.58

Frequently Asked Questions About Probate Real Estate Services for Attorneys and Fiduciaries in San Francisco
What does a probate real estate agent do for attorneys in San Francisco?
Allison's San Francisco probate process lists valuation, pricing, listing and marketing, buyer qualification, overbid preparation and escrow oversight.2 In San Francisco, counsel must appear at sale confirmations.6 Allison's process lists defensible documentation suitable for filing and active management of confirmation requirements.2
Does a San Francisco probate sale need court confirmation?
It depends on authority. A San Francisco personal representative with limited IAEA authority needs court supervision to sell real property.3 One with full authority can sell after a notice of proposed action, unless someone objects in writing.16,27
What does the San Francisco probate court require in an exclusive listing petition?
San Francisco's local rule requires the broker's name, office and "experience with sales of real property in the area of the subject property," plus the properties to be sold, with the agreement attached.6 State rules add a summary of terms and the facts showing necessity and advantage.17 The listing can run no more than 90 days at a time.11
How is the broker's commission set on a San Francisco probate sale?
On a court-confirmed San Francisco sale, the court fixes the commission, and it can't exceed the listing contract.34,35 The court ordinarily allows no more than 5 percent in total, or 10 percent for unimproved property.6 Commissions are negotiable.6
How does an overbid work at a San Francisco confirmation hearing?
The first overbid must be at least 10 percent more on the first $10,000 and 5 percent more on the rest of the original bid.33 In San Francisco, the winning overbidder brings a cashier's or certified check for 10 percent of the initial overbid.6 Counsel completes the clerk's overbid form that morning.6
Who gets the commission when an overbidder wins in San Francisco probate court?
The Probate Code sets the split by scenario.38,39,40,41 Say the original bid came through one broker and a different broker's buyer wins with an overbid in San Francisco probate court.41 Section 10165 gives the winning broker half the commission on the original bid and all of it on the increase.41 Counsel should confirm the split for the case.
Can a conservator sell a conservatee's home in San Francisco?
Yes, but the bar is high. A San Francisco conservator must notify the court before committing significant resources to the sale.4 The court needs clear and convincing evidence of a compelling need,43 and the appraisal must generally be no more than six months old.42
Does a successor trustee need court approval to sell San Francisco real estate?
No, not for powers granted by the trust or by statute. A San Francisco trustee has the powers in the trust and those given by statute, including the power to sell, without court authorization.5,46 The trustee still owes duties of impartiality, prudence and keeping beneficiaries informed.48,49,50
What should a professional fiduciary look for in a San Francisco listing agent?
Look for verifiable San Francisco sales of the same property type, a written process and clean records. The Bureau's code of ethics tells fiduciaries to avoid conflicts and keep detailed records.10 San Francisco's exclusive listing petition also asks for the broker's local sales experience.6
Do tenants have to sign estoppels when an estate sells a San Francisco building?
Not necessarily. San Francisco's Rent Ordinance disclosure tells tenants they aren't required to sign estoppel certificates, except as required by law or their rental agreement.55 Counsel should decide how the disclosure rule applies to the estate or trust seller.
